These Terms of Use ("Terms") govern your use of tubswap.com and related services (the "Service"), operated by The Etcetera Companies LLC, doing business as TubSwap ("TubSwap," "we," "us," or "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. What TubSwap is — and isn't

TubSwap is a free advertising and matching service that connects homeowners with third-party home-improvement contractors, providers, and marketing partners. We are not a contractor, installer, or licensed home-improvement professional. We do not perform work, provide quotes, set prices, supply materials, or guarantee any project. Any agreement for work is solely between you and the provider, on their terms.

2. Eligibility

You must be at least 18 years old, a homeowner or authorized on behalf of one, and a U.S. resident to use the Service. By using it, you represent that you meet these requirements and that the information you provide is accurate.

3. Your consent to be contacted

By submitting your information and agreeing to our consent language, you authorize TubSwap and its home-improvement and marketing partners to contact you about bathroom and home-improvement options — including by automatic telephone dialing system, prerecorded or artificial voice, and text message — at the phone number you provide, even if that number is on a state or federal Do-Not-Call list. This consent is not a condition of purchasing any goods or services. You may revoke consent at any time by replying STOP to texts, telling a caller to stop, or contacting us. Message and data rates may apply.

4. Accurate information

You agree to provide true, current, and complete information and to use the Service only for lawful, personal purposes. You may not submit another person's information without authorization, attempt to gain unauthorized access, interfere with the Service's operation, or use the Service fraudulently.

5. No guarantees

We do not guarantee that any contractor or partner will contact you, or the price, financing, availability, workmanship, materials, timeline (including any "as little as a day" installation), licensing, insurance, or quality of any provider or project. Statistics or examples on the Service describe the market generally, not your result. Submitting the form is not a contract for work. You are responsible for vetting any provider before hiring.

6. Intellectual property

The Service, including the TubSwap name, logo, text, and design, is owned by or licensed to The Etcetera Companies LLC and protected by law. "TubSwap" is a trade name of The Etcetera Companies LLC. You may view the Service for personal, non-commercial purposes; you may not copy, modify, reproduce, or distribute it without our prior written consent.

7. Third-party providers

The Service transmits your information to third parties, including contractors and marketing partners. We do not control and are not responsible for any provider's or partner's products, services, conduct, work, content, or practices. Your dealings with them are solely between you and them, governed by their terms and privacy policies.

8. Disclaimer of warranties

The service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the service will be uninterrupted, error-free, or secure, or that any provider is suitable, licensed, or qualified.

9. Limitation of liability

To the fullest extent permitted by law, The Etcetera Companies LLC and its members, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss arising from or related to your use of the service or from any work performed by a provider, even if advised of the possibility of such damages.

You agree to indemnify and hold harmless The Etcetera Companies LLC from any claims, damages, liabilities, and expenses arising out of your use of the Service, your dealings with any provider, or your violation of these Terms.

10. Governing law

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict-of-laws rules. Any dispute relating to these Terms or the Service will be subject to the exclusive jurisdiction of the state and federal courts located in Wyoming, unless otherwise required by applicable law.

11. Changes

We may update these Terms from time to time. The "Last updated" date reflects the latest version, and your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
